Customer Review: Mixed Feelings - Poor Support - Serious Legal Questions

I purchased a TomTom GPS unit for my wife for Christmas 2009. She has used it daily ever since, without problems. I have used the device a few times as well and found it very useful, providing accurate information.
Thus for this Christmas I asked for the Tom Tom XXl-540 (wanted the larger screen) as a present, based on the very positive past history with a TomTom GPS.
However, as I posted in the GPS discussion boards, I unfortunately met with quick problems with the device, TomTom support, and possible ethical/illegal actions by Amazon.
I received the Tom Tom XXL 540-S for Christmas (2010-12-25). That evening I hooked it up to my computer to install Tom Tom Home and check for updates - as is recommended in the user guide.
1. As soon as I hooked up the Tom Tom unit, I received a message that the Tom Tom Home installation software was OUTDATED and that I had to download the new software.
(BRAND NEW UNIT - just ordered less than a week before Christmas, through Amazon - yet the software is outdated)
2. Download the new Tom Tom Home software and install. That went fine. However, one of the first things you have to do is check for updated maps. Turns out, the installed maps were outdated, so I was instructed to Update the Maps.
3. Here is where the problem began. I was unable download/install the necesary updates!! The device kept stopping and giving me a series of error messages:
"ERROR: Internal/AssertFail: Code bug: We're sorry but an error has occurred during the use of HOME on your computer. Please contact Customer Support.

As it was Christmas, no one was available for customer support, so I tried the website. No useful help available. So I sent an email to Tom Tom detailing the problem.
4. I received back an email from Tom Tom stating:
"Dear Sir or Madam,
Thank you for contacting TomTom Customer Support. We have been experiencing an unusually high number of incidents which has been affecting response times. Your question has been received and you will receive a response from our support team as soon as possible.

The TomTom Customer Support Team"
5. Perfectly understandable automated response considering the date (Christmas). No Tech Support on Sundays, so I started calling on Monday. It took several days to get through to TomTom support.
6. One thing I did notice - the TomTom drive has very little free disk space (16.6 MB). That extremely limited disk space will prevent anyone from doing the REQUIRED updates!
Additionally, I checked the TomTom folder and noticed nearly 13 MB of "Recovered File Fragments" all dated 9/15/2010. This TomTom was purchased as NEW from Amazon.com in December, 2010 - thus why should there be ".chk" file fragments?
IMHO, that indicates that either this device is defective from the TomTom factory, or Amazon.com sold me "mislabeled" goods, as there is NO LEGITIMATE REASON for ".chk" files to exist on a BRAND NEW DEVICE!
After several days of calling TomTom Customer Support, they finally resolved the problem. However, the resolution is very SCARY, and raises major questions about TomTom or Amazon.
1. As mentioned above, one issue I noticed were the NUMEROUS ".chk" files - file fragments - files THAT UNDER NO CIRCUMSTANCES SHOULD EVER EXIST ON A BRAND NEW UNIT!!!!!!
2a. The Tom Tom tech had me delete the preloaded maps from the Tom Tom unit and the TomTom Home folder from my hard drive.
2b. Then I had to reinstall TomTom Home again - a new version was just released about a week or 2 ago.
2c. After installing the new version of Tom Tom Home, then I was able to download and install the upgraded maps.
(I had done all this on Christmas, when I received the Tom Tom - but apparently there was an issue with the online software available at the time.
3. Here is where the MAJOR ISSUE lies: In order to resolve the problem, one thing I had to provide to TomTom Support was the serial number of the TomTom Device. The support person ran a check of that serial number and discovered that my TomTom was manufactured during week #45 - which was the SECOND WEEK OF NOVEMBER, 2010!!
My TomTom was ordered was ordered from Amazon roughly Dec 15, 2010.
The issue?? If the device WASN'T EVEN MANUFACTURED until November 2010, and was sold in December 2010 - how the BLEEP did the GPS have file fragments dated 9-15-2010 on its drive??? The only way for file fragments to be created is when one runs a check disk function.
The TomTom tech said he would send this matter for investigation - just in case there is a problem at the factory. However, he noted that in his opinion what happened is that Amazon sent me a "B Stock" (refurbished) unit instead of a new one and attached a false serial number to my unit!!!
How does Amazon.com obtain serial numbers for products? Why would they intentially DEFRAUD consumers by selling refurbished merchandise and ILLEGALLY attaching a falsified serial number to that device. This is 100% against the law, and Amazon could face FEDERAL criminal charges if this is what they are doing!!
This is a SERIOUS problem!! Do the TomTom devices arrive at Amazon.com WITHOUT serial numbers? Does TomTom supply Amazon with serial numbers?? If not, how would Amazon obtain such serial numbers?? Did Amazon slap on an "illegally obtained/erroneous" serial number on a refurbished device as the TomTom tech suggested?? Or is there a problem at the factory that loads the software onto the TomTom devices?
That issue needs to be INVESTIGATED IMMEDIATELY, because if the problem is at Amazon, then Amazon is engaging in CRIMINAL ACTIVITY. If the problem is at the TomTom end, then that would speak volumes about the LACK of quality control at TomTom.
The device is currently working, although I haven't had much opportunity to test it. Another concern was that on Amazon it mentioned the device has free map UNGRADES. Turns out, on the 540-"S" - there are NO map upgrades - just 1 map upgrade allowed. And that upgrade occurs when you first install the TomTom as everything was recently upgraded. So I had to upgrade my device BEFORE I was ever able to use the device.
My poor rating is due to how long it took for TomTom to resolve the issues with the GPS, and the MAJOR ethical/legal implications if what TomTom claims is true - that Amazon sold me a refurbhised item as new, slapping a falsified serial number on the unit!!
